By accessing and using the Platform, you affirm that you are either an individual over the age of 18 or a parent or legal guardian providing consent for your child’s use of the Platform. If you are a parent or legal guardian, you are responsible for monitoring and supervising your child’s use of the Platform.

2. Use of the Platform

a. Content: The Platform provides educational games, videos, and other learning materials for children. All content available on the Platform is intended for educational purposes only. You acknowledge and agree that the content may vary in complexity and suitability based on the age and abilities of the child using the Platform.

b. User Accounts: In order to access certain features of the Platform, you may be required to create a user account. You agree to provide accurate and complete information during the registration process and to keep your account credentials secure. You are responsible for all activities that occur under your account.

a. Propertya. Ownership: All intellectual property rights in the Platform, including but not limited to the games, videos, graphics, and text, are owned by or licensed to Enrichly. You acknowledge that you have no right, title, or interest in such intellectual property.

b. Limited License: Subject to your compliance with these Terms of Service, Enrichly grants you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.

5. Limitations of Liability

a. Disclaimer of Warranties: The Platform is provided on an “as is” basis without warranties of any kind, whether express or implied. Enrichly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

b. Limitation of Liability: In no event shall Enrichly be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, even if Enrichly has been advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.

c. Indemnification: You agree to indemnify and hold Enrichly, its affiliates, directors, officers, employees, and agents harmlessfrom any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Platform, your violation of these Terms of Service, or your infringement of any intellectual property or other rights of any third party.

6. Modifications and Termination

a. Modifications: Enrichly reserves the right to modify, suspend, or discontinue the Platform or any part thereof, with or without notice. Enrichly shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

b. Termination: Enrichly may terminate your access to the Platform at any time for any reason, without prior notice. Upon termination, you must cease all use of the Platform and delete any copies of the Platform or its content in your possession.

7. Governing Law and Dispute Resolution

Any dispute arising out of or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts of Texas.

8. Miscellaneous

a. Entire Agreement: These Terms of Service constitute the entire agreement between you and Enrichly regarding your use of the Platform and supersede any prior agreements or understandings.

b. Severability: If any provision of these Terms of Service is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

c. Waiver: The failure of Enrichly to enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
